Durban businessman Sifiso Zulu is seeking leave to appeal to the Supreme Court of Appeal against his three-year jail term for culpable homicide, the NPA said on Thursday.
“Zulu lodged his application in the Pietermaritzburg High Court on Wednesday,” said National Prosecuting Authority (NPA) spokeswoman Natasha Ramkisson.
His appeal against his conviction and sentence was dismissed by the Pietermaritzburg High Court on Friday.
Zulu, 42, the former head of the Durban Chamber of Commerce, was convicted in April 2010.
The court found that Zulu, driving a BMW X5, had jumped a red robot and crashed into a bakkie, killing two members of the Souls Harbour Church and injuring eight others in March 2008.
He was sentenced to five years in jail (two years of which were suspended), and was fined R7000 for various driving offences.
Durban police served Zulu with “notice to surrender” on Tuesday afternoon when he failed to arrive at Westville prison to start serving his jail term. He had until 10.30am on Friday to present himself to the authorities.
The Mercury reported on Thursday that Zulu was arguing in his application that Judge Piet Koen was wrong to uphold the trial court’s finding that he was the driver of his vehicle, as witnesses had testified that Bongumusa Gumede was the driver.
Zulu’s application was expected to be heard on Thursday.
