Baboon jibe victim cries for justice

A security guard at the Khayelitsha magistrate's court says only President Jacob Zuma can help him see justice after his case against a police officer who called him a baboon was postponed five times

Sowetan reported earlier this year that Senior Superintendent Christiaan Tron had appeared in the court on charges of crimen injuria for allegedly calling security guard Bulelani Mgcewu a "baboon".

This was after Tron had parked in a bay designated for a magistrate and refused to move his car when Mgcewu told him to.

After Mgcewu laid a charge, Tron allegedly offered to buy him a car if he dropped the charge.

This led to charges of bribery and defeating the ends of justice being added to the case.

The case was postponed three times by the Khayelitsha magistrate's court before being transferred to the Bellville commercial crimes court.

It has been postponed again to March 24 next year.

To make matters worse, the latest postponement was done in the magistrate's chambers, and he was not consulted, Mgcewu said.

"Tron didn't even stand in the dock. I was very disappointed," he said.

Mgcewu added that during Tron's appearances in Khayelitsha he said he did not want the case to be heard in the township but preferred that it be moved toBellville.

Bellville is a former white suburb. "His wish was granted. Now everyone in Bellville is white, just like him. They are all on his side and his office is just next door," said Mgcewu.

"Judging by these delays, I will never see justice. That's why I'm drafting my letter of concern to President Zuma and Minister of Justice, Jeff Radebe. I want them to see how rife racism is in Cape Town. I feel as if I'm the accused in this case," added the disgruntled guard.

"Why is he not taking the stand? The evidence is there. He called me a baboon in front of my colleagues and they can attest.

"The provincial justice department wants him to get away with his racist remarks because he is white," Mgcewu said.

Prosecutor Bheki Hlela said, "A case of crimen injuria is a very serious charge on its own as it involves racialexpressions.

"If we let this continue we'll be failing the values we fought for. Bribery and defeating the ends of justice are very serious crimes since corruption is rife in our country."
