Flo Rida's lawyer claims his client doesn't need to pay over $400,000 for failing to appear at Fat As Butter festival in Australia in 2011 because he is an American citizen.

The 'Whistle' hitmaker was ordered to fork out over $400,000 for failing to appear at the Fat As Butter music festival in New South Wales in 2011, but is now claiming the Australian courts have no jurisdiction over him since he is an American citizen. Referring to the date when legal proceedings began, Nick Furlan, the singer's lawyer, said: ''My client is an American resident who lives and works in America.

There was no evidence that [Flo Rida] was in NSW on April 13 [2012].'' As the party-loving star was unreachable during his last April 2012 visit to Australia for the Supafest tour and his Melbourne Logies appearance, the judge famously allowed the legal documents to be served on him via Facebook. Fat As Butter festival promoter Brent Lean of Mothership Music won his legal battle against Flo Rida - real name, Tramar Dillard - for breach of contract last August, seeking $380,400 in damages and $37,745 in legal fees.

According to FasterLouder.com, Flo Rida failed to arrive at the Fat As Butter gig after throwing a ''hissy fit'' and allegedly refusing to travel to the festival ground, despite having been paid for the performance months in advance. A Facebook statement from the festival read: ''Since he's been on his Australian tour, he's been an absolute tonk.''
