Boy (10) arrested for raping girl (7)

TRANSKEI police have arrested a 10-year-old boy who is alleged to have raped his seven-year-old neighbour at the weekend.

Mqanduli police spokesman major Zamukulungisa Jozana said the boy was arrested yesterday at Togwana village in Khalalo administrative area in Mqanduli.

 “He was taken to a social worker after the arrest. When we arrest minors we don’t sent them to jail, we take them to social workers and then they go straight to court. Even after court, they get released to the parents’ custody.”

Jozana said the mother had allegedly left her daughter with a friend when visiting neighbour’s house. “When she came back, she saw that the two were in her other neighbour’s house and called them,” said Jozana.

He said the mother had noticed that her daughter had been limping and after inspecting her, found that she had been raped.

The girl was taken to a clinic on Monday where it was reportedly confirmed that she was raped. The mother opened a case later on Monday.

Professor Stephen Tuson, a criminal law expert at Wits University, said in cases where minors are perpetrators, they first had to be examined by social workers.

He said in terms of the Child Justice Act, it should first be determined if a child of a certain age has the capacity to commit crime.

“A social worker has to be immediately called to see if the child is wise, handicapped or normal,” said Tuson.

  • In the same village, a 34-year-old mother was taken from her home and raped.

“She had been in her house with her daughter [15] when someone broke in using a rock. He allegedly dragged her to a nearby forest and was repeatedly raped by the man the whole night,” said Jozana.

He said the man, who was known to the woman, was later apprehended by villagers. The man was reportedly assaulted.

“The man is in police custody now and he is not badly injured,” said Jozana.

Asked what might have prompted the alleged assault on the accused by villagers, Jozana said the villagers had apparently had enough as there were a number of rape incidents in their area.

  • In other crime incidents, a 27-year-old woman was shot by her boyfriend in Baziya village in Mthatha yesterday.

Mthatha police spokesman Lieutenant-Colonel Mzukisi Fatyela said the 35-year-old man had shot the woman and later shot himself in the head following an argument.

“We don’t know what started the argument but the man had apparently been from his wife who works at the Mthatha central police station.”

The man, a taxi driver, did not die from the incident and is currently in a critical condition at the Nelson Mandela Academic Hospital, said Fatyela.

He said police recovered a 9mm pistol and four rounds of ammunition at the scene.
