Scopa wants TEB deal explained

THE North West department of social development will once again appear before Standing Committee on Public Accounts (Scopa) regarding an agreement to move into a new building.

On Tuesday the department will appear to explain how they, through head of department Matshidiso Mogale, entered into an agreement with TEB Properties, about moving into TEB's building.

The department failed to honour their February 18 appointment, where they were supposed to provide Scopa with documents about procurement processes that were followed in awarding TEB Properties the contract - and also documentation of the rental agreement between TEB properties and the department.

Documents seen by Sowetan show that an agreement between the department and TEB Properties was entered into in October last year for renting out the building.

Sowetan has also established that, despite the objections of suspended head of department Lucas Malaka, opposing the move to the building, the department, through Mogale, went ahead and signed an agreement.

Before he was suspended in early 2012, Malaka wrote to Wandile Bozwana of TEB Properties on February 9 2010 informing him about his intention to stop the proposed move into the building.

Bozwana then took the matter to both the high court and the Supreme Court of Appeal, where the courts twice ruled in the department's favour.

Despite the court ruling, Mogale still entered into an agreement with Bozwana.

On October 31 last year, Mogale wrote to Bozwana acknowledging "receipt of your offer of office accomodation ... and wish to advise that we accept the offer..."

Bozwana confirmed that he had an agreement with the department, but terminated it "around November" last year as the department had not committed to a long-term contract, but a month-to-month contract.

The department, through spokesman Vuyile Ngesi, said: "The department is unable to comment on the disciplinary processes against L Malaka as it has not yet been concluded. Furthermore, the department would like to put it on record that no agreement has been entered into with TEB Properties. Normal supply chain management processes are under way to find a suitable service provider for office accommodation." - selebim@sowetan.co.za
