Lawyers, doctor in R6m Road Accident Fund fraud case

A FRAUD case against six Pretoria attorneys and a medical doctor who allegedly defrauded the Road Accident Fund (RAF) of R6-million was yesterday postponed in the Pretoria Magistrate's Court.

The seven men, together with a "tout", face a total of 54 charges after they allegedly exaggerated injuries of road accident victims in order to inflate claims.

They also allegedly lodged claims for individuals who were not involved in accidents.

It is alleged that the attorneys - HB Molefe, DS Selahle, AS Mathumo, MP Phooko, SB Mabena and M Ramafolo - and tout S Moche colluded to defraud the RAF.

The RAF alleged that Molefe submitted 98 claims for an accident which involved only 30 people.

By the time this was discovered, the RAF had already paid out R6-million to Molefe on behalf of the victims.

RAF spokeswoman Connie Nel said the arrests came after several months of investigation by the RAF in conjunction with the police.

She said it all started last year when a Botlhaba Tshwane Transport bus overturned in Pretoria and 98 claims were received for injuries sustained.

The claimants apparently had consulted Dr Lebogang Mosweu and the claims were submitted by Molefe's law firm, but affidavits of the respective claimants were allegedly commissioned by various attorneys.

It is alleged third party claims lodged were referred to Mosweu, who provided medical certificates for claimants he had not physically examined.

The court heard that the RAF investigation had revealed that only 30 passengers were on board at the time of the accident.

Mosweu is facing additional charges.

It is alleged that a few months after this accident, 13 more claims were made following a collision between a taxi and a light delivery vehicle in Lenasia.

Mosweu was named as the "consulting doctor" and it was later discovered that only three people were in the taxi at the time.

Mosweu and Molefe yesterday refused to comment when contacted by Sowetan .

Mosweu referred us to his lawyer, whose phone rang unanswered, while Molefe said he would comment at a later stage.

The attorneys and the doctor had earlier each been granted bail of R10000, and the agent bail of R1500. - alfredm@sowetan.co.za
