NPA to hand over Zuma record to DA

THE National Prosecuting Authority (NPA) will hand over a record of its decision not to prosecute President Jacob Zuma in 2009 to the DA, the authority said yesterday.

The NPA's Mthunzi Mhaga said they decided not to appeal against a Supreme Court of Appeal (SCA) judgment to the Constitutional Court and that it would follow the process set out in the SCA judgment.

The SCA upheld an attempt by the DA to gain access to the records that led to the suspension of criminal charges against Zuma.

The court decided the record should exclude written representations made on behalf of Zuma and any consequent memoranda or reports prepared in response, or oral representations, if their production would breach confidentiality agreements.

Then acting National Director of Public Prosecutions Mokotedi Mpshe took the decision not to prosecute Zuma.
