Prosecutors in Mpumalanga have declined to prosecute Mzilikazi wa Afrika - but police are refusing to release him.
This is according to a communication to staff from Sunday Times Editor Ray Hartley.
"Our lawyers are talking to the police," he said.
"If we don't get any joy we are going to the High Court to seek his immediate release.
"There is a phrase for this: Detention without trial."
