Nicolien Fransien Du Plessis‚ whose late father‚ Nicolaas Frans Joubert‚ was wrongfully arrested and detained by police officials from the Marikana Police station‚ is set to receive R25 000 in damages from the Minister of Police.
Prior to the hearing‚ Joubert died of natural causes and Du Plessis was appointed as the executrix of his estate.
“Du Plessis received the offer of settlement from the Minister on 26 October 2016‚ a number of years after action was initially instituted by Joubert at the Pretoria Division of the High Court of South Africa‚” said her attorney‚ Jean-Paul Rudd.
On 18 December 2010‚ police arrested Joubert at his Swartkoppies home‚ following his alleged involvement in a hit-and-run accident.
“The officials purported that Joubert was the sole cause of a collision‚ had failed to stop and render assistance‚ and had not reported the collision to the police.”
During his detention‚ Joubert suffered a burst ulcer‚ lost consciousness and was taken to the Phokeng clinic. He was thereafter transferred to the Job Shimankana Tabane Provincial Hospital‚ where he was administered antibiotics (to which he was allergic) without his knowledge or permission.
Joubert was released from detention the following day and all the charges were later withdrawn against him.
“The Minister was also ordered to pay costs of the action‚” said Rudd‚ a partner with the Commercial‚ Property and Litigation practice of law firm Adams & Adams.
