NUM to fight retrenchments at ASA Dilokong Chrome Mine

The National Union of Mineworkers (NUM) says it will fight the planned retrenchments of hundreds of workers at the ASA Dilokong Chrome Mine in Limpopo.

The NUM said on Wednesday that the mine had served the union with a Section 189 notice in terms of the Labour Relations Act indicating it was contemplating retrenching up to 700 workers.

But it charged that the mine’s owners were not following “the due processes of the law in terms of the Labour Relations Act (LRA) and Minerals and Petroleum Resources Development Act (MPRDA)”. 

 It said the company must implement Section 189 of the Labour Relations Act of 1995 at the same time as Section 52 of the Minerals and Petroleum Resources Development (MPRDA) Act of 2002 which stated that if a company planned to retrench 10% or more of its workforce it had to inform the Minister of Minerals Resources.

 “The NUM request Minister of Mineral Resources Mosebenzi Zwane to intervene immediately to stop this drastic action by the company that will leave hundreds of mineworkers in a dire situation and the surrounding communities in Limpopo‚” the union said in a statement.

 It added it was “highly” disappointed that the mining company had turned down several requests to meet with the NUM in an effort to try to resolve problems at the mine.

The union said it was also consulting with its legal team to challenge the non-payment of workers at the mine since November.

 “We want to appeal to the Commission for Conciliation‚ Mediation and Arbitration (CCMA) to prioritise this matter and do the correct thing by calling the parties to a facilitation process‚” said Phillip Mankge‚ NUM North East Regional Secretary.
