Reserve Bank official must pay R50,000 in damages, and legal costs
A CCMA official has won her libel case in the High Court in Pretoria after being called “stupid”.
The court on Thursday ordered Nelspruit resident Michael Mogorosi to pay plaintiff Elsabe Maree R50,000, and to settle her legal costs.
Mogorosi slandered Maree in various letters in 2007, after she mediated in a case of unfair labour practice between him and the SA Reserve Bank.
Maree stated in documents submitted to the court that Mogorosi had written letters to two other Commission for Conciliation, Mediation and Arbitration (CCMA) officials to express his dissatisfaction with the way she had handled his case.
In the letters, he referred to Maree as “lacking in common sense”, said she had “misunderstoood the facts of the case” and that she was either “incompetent, stupid, or in cahoots with the Reserve Bank”.
Mogorosi’s third letter, addressed to former Reserve Bank governor Tito Mboweni, stated: “You will laugh at the idiotic findings of commissioner Maree”.
According to Maree, Mogorosi tried to ruin her good name by questioning her impartiality.
Mogorosi stated in his letter to Mboweni that his working conditions at the Reserve Bank had become unbearable, and that he had effectively been demoted from manager to clerk.
