An avid All Blacks fan, who had painted his face black just before a big match, has sued cash-in-transit company G4S Cash Solutions for damages after one of its security guards mistakenly thought he was a masked robber and shot at him outside the Gelvandale Spar in Port Elizabeth.
Two women waiting at a nearby ATM to draw money, who were wounded during the incident, have also instituted claims against the company, The Herald Online reported on Wednesday.
G4S Cash Solutions has denied liability for all three claims, totalling just under R500,000.
In papers before the Port Elizabeth High Court, G4S said that on August 1, 2009 its security guard, Fumene Maswana, had collected R100,000 from the Spar.
He was taking it to the security vehicle when he saw a man dressed in black and with his face covered in black paint approaching. Thinking the man looked like a robber, Maswana fired a shot at him.
Business owner Walter Arendse, of Windvogel, an avid All Blacks supporter, said in papers before court he had been going to the Spar to buy supplies for his business when the guard shot at him.
He was not wounded, but the bullet ripped through his leather jacket and shattered his cellphone.
According to medical reports, he now suffers from depression and post-traumatic stress.
He is suing G4S for R161,917.
Bernadine Plaatjies, from Helenvale, was standing at the ATM when the bullet hit her in the thigh. She is suing for R157,000.
Grace Sauls, also from Helenvale, was shot in the buttocks and is also suing for R157,000.
The legal team for the three claimants have amended their claim to include an allegation that Fumene had discharged his firearm in an unnecessary, inopportune and unsafe manner.
G4S’s counsel will get an opportunity to respond to this amendment before a date is set for the trial to resume.
