Siboza looks unlikely to account for himself

IT remains to be seen if the Nkomazi municipality will ever be able to bring its former acting manager Thokozani Siboza to book after public protector Thulisile Madonsela recommended a disciplinary hearing.

In her report into allegations of improper conduct by Siboza in terminating an investigation by the integrity management unit (IMU) without authorisation, Madonsela recommended disciplinary action against Siboza who has since resigned.

The report Madonsela signed on July 14 says the Nkomazi municipal council resolved to establish a section 79 committee to assess the performance of the administration in implementing its resolutions during the period from June 2006 to October 2008.

The committee's establishment consequently led to the suspension of the then municipal manager Sabelo Shabangu on November 4 2008, "in order to allow an investigation into municipal administration".

On the same day, Nkomazi executive mayor Johan Mavuso wrote Shabangu a letter saying he had been mandated by council to suspend him from office.

Shabangu later discovered that Siboza had terminated the investigation by the management unit and lodged a complaint with the public protector on March 27 2009.

Shabangu alleged Siboza had terminated the investigations in order to prevent evidence of corruption on his part.

Shabangu was fired on June 10 but is contesting his dismissal from the municipality.
