Maila said Health Connection had a special offer in June and it convinced him to join.

He claimed that the gym's representative, John Lewis, told him he did not have to pay a joining fee.

"John said I could pay in monthly installments until the contract was paid up, but they took the whole amount at once," Maila said.

They debited his account with R5000 when he signed up, he said.

"I decided to cancel the contract because I had not given them permission to take the whole amount."

Maila said he cancelled his contract verbally, but John asked him to do it in writing, which he did.

"I hand-delivered my cancellation two days later, within their five-day cooling-off period."

Health Connection director Niels Brits told Maila they would not cancel the contract nor give the money back, Maila said.

"For the past six months I have been asking Brits to adhere to the contract. He does not return my calls and has ignored the letters of demand that Legalwise sent him.

Brits has failed to respond to more than 15 calls and faxes from Sowetan.

The Office of Consumer Affairs in Gauteng has agreed to investigate Maila's complaints.
