Cape waiters in court for credit card scam

Four Cape Town waiters appeared in the city’s magistrate’s court  on Friday on fraud charges for allegedly using a skimming device to  clone credit cards

Their case was postponed to Monday, when they were expected to apply for bail, and would remain in custody until then.

Magistrate Nasha Barnwari ruled it unreasonable to keep them in custody for a full week, as requested by prosecutor Cassius Klassen.

Before the court were Zimbabweans Oswell Mutungira, 35, of Blaauberg, Luke Nyabadza, 26, of Sea Point and Marshall Choto, 28, of Milnerton, and Malawian Ganizani Berlington Kaluwa, 28 of Maitland.

Defence attorney Howard Andrews said the men were arrested in the early hours of Wednesday, in the bar where they worked.

Western  Cape police spokesman Lieutenant-Colonel Andre’ Traut said last week  it was a restaurant in Burg Street.

The prosecutor wanted to confirm their residential addresses, but Andrews said the police had already done this. Andrews said the  men had been taken to their homes to have the premises searched immediately after their arrests.
