Suspended ANC Western Cape chairman Marius Fransman has reportedly approached the Western Cape High Court in a bid to be reinstated.
This comes as confusion reigns as to whether he’s entitled to resume work or not.
Fransman is insisting that he is no longer suspended. However‚ the ANC insists he has not been reinstated and that he is still facing a disciplinary hearing.
The national working committee of the ANC asked Fransman to step down earlier this year in the wake of sexual assault allegations leveled against him.
Fransman cannot resume duties until he appears before disciplinary committee: Mantashe
The party launched an investigation into claims he sexually assaulted his former assistant Louisa Wynand.
The matter is also being investigated by the police.
Fransman apparently reported for work on Monday after issuing a statement at the weekend saying he was resuming his duties.
In the statement‚ he claimed: “I have never ceased to be the Western Cape ANC leader since my election to the office. I have voluntarily stepped aside to allow the integrity commission to conclude its work without interference‚ and am now assuming my duties and responsibilities again at the conclusion of that process. My prolonged absence was only the result of a poorly managed internal process.”
The organisation’s head of elections‚ Nomvula Mokonyane‚ also stated last week that Fransman was back and that “issues have been resolved”. However‚ ANC spokesperson Zizi Kodwa later said the embattled Western Cape leader had not been officially reinstated and repeated the statement on Monday evening.

The statement was echoed by ANC general secretary Gwede Mantashe who reiterated that the ANC’s integrity commission which was handling Fransman’s matter had completed its work and had recommended that the case be given to the disciplinary committee. But‚ as Fransman had not yet appeared before the disciplinary committee‚ he could not return to his position.
Mantashe added that members of the party must respect the decisions taken by its structures.
“As I said last week and I am repeating it…decisions in the ANC are taken by structures. If you wake up and do as you wish you are actually fishing for trouble‚” Mantashe said.
