Dalindyebo is living on borrowed time

Thembu King Buyelekhaya Dalindyebo is one day away from going to jail.

Yesterday, the king was seen driving around Mthatha in his luxury car while in the Mthatha High Court his top legal team consulted with Judge Lusindiso Pakade over the king's appeal for an extension of bail while he takes his matter to the Constitutional Court.

The argument followed after the National Prosecution Authority (NPA) filed the notice to oppose bail and brief heads of argument. The case was supposed to have been heard yesterday, but Pakade decided to postpone it until today.

NPA spokesman Luxolo Tyali said: "All the reasons for opposing bail will be canvassed in court. They are in the papers and we submitted them this morning."

North West NPA senior deputy director of prosecution Nigel Carpenter was in court yesterday to oppose bail.

In 1995 Carpenter successfully prosecuted Dalindyebo in the Mthatha High Court for a string of serious crimes for which the king was eventually sentenced in 2009 to 15 years in jail.

The Mthatha High Court found Dalindyebo guilty of culpable homicide, kidnapping, arson, defeating the ends of justice and assault.

Dalindyebo appealed to the Supreme Court of Appeal (SCA) and was granted R6000 bail.

The SCA acquitted him only of culpable homicide and sentenced him to 12 years in jail for the rest of the crimes.

Dalindyebo has now appealed to the Constitutional Court but if his bail application takes longer than expected he will start his jail term tomorrow, from where he will have to carry on waging his case.

He was given 14 days from the day of the sentence, October 1, to report to prison.

His traditional advisers are confident the king won't be thrown in the slammer.

"We have confidence in the court that it will extend bail. Since he has been out on bail, he has not broken a single one of the bail conditions," his spokesman Mfundo Mtirara said.

The king has hired a new legal team that includes attorney Etienne Naudé and well-known advocate Jaap Cilliers.

Cilliers has defended Wouter Basson, Jackie Selebi and the Waterkloof Four, among others.
