SOCCER star Bryce Moon's application to have charges against him discharged was delayed yesterday as the presiding magistrate was off sick.

Moon is expected to bring an application for discharge owing to lack of evidence to secure a conviction today, when presiding magistrate Vincent Pienaar is expected back at work.

Moon, who was accompanied to court by his parents Patrick and Geraldine, wants the court to drop charges against him of murder, alternatively attempted murder, drunk driving, alternatively driving while having an excessive amount of alcohol in the blood, reckless and negligent driving, alternatively inconsiderate driving.

The charges arise from a June 2009 car crash which claimed the life of Sandhurst, Sandton, domestic worker Mavis Ncube.

Ncube died in hospital from head and pelvic injuries after Moon, who was allegedly driving at high speed, failed to negotiate a bend.

His car was found wedged between a tree and a wall after the crash.

The trial has been marred by several delays since it started.

The state says it will oppose Moon' s application.
