Cop murder accused 'suffers from asphyxia'

THE bail application by one of the men suspected of murdering a police sergeant at Itsoseng in Lichtenburg, North West, two months ago was on Friday postponed by the Itsoseng Magistrate's Court.

Magistrate Andrea van Rooyen postponed the bail application by Benny Koloane to tomorrow, when police are expected to testify.

Koloane, 20, Amos Haman, 20, and Pitso Mmatlhi, 19, are facing charges of murder and robbery with aggravating circumstances after the brutal stabbing of Sergeant Keneilwe Seleke outside his home.

Advocate Nzame Skibi of Mafikeng Justice Centre pleaded on behalf of Koloane for the court to give him bail. He said Koloane should be given bail because he was a first offender and also because he was suffering from a disease called asphyxia.

He said Koloane's brain did not get enough oxygen when he was born, that he also failed to cry at birth and that he was a slow learner and could not be detained with inmates who possess normal senses.

He said the place where Koloane was detained was not conducive for a person of his mental capacity.

Skibi also said Koloane was attending a special school at the time of his arrest and needed to prepare for his final examination.

"The continued detention of my client will disrupt his education. He is young and has a clean record," Skibi said.
