Rape suspect says sex with 14-year-old was consensual

JUDGMENT in the case of a man - charged with raping and assaulting a teenager after an alcohol-fueled attack - will be handed down on Monday.

The accused, aged 20 at the time of the 2008 attack, is charged with raping a 14-year-old girl who lived in Eldorado Park, south western Johannesburg.

Wearing a green and yellow Bafana Bafana tracksuit top and black tracksuit pants, the accused told a half-filled Protea magistrate's court yesterday that the teenage girl was his "girlfriend" and that they had "consensual sex".

He described how he and the "girlfriend" - along with two friends - had spent the afternoon drinking at a friend's house.

"I told my friend that I had to go to work the following day - so we had to finish (have sex) what we came here to do," the accused told magistrate Reginald Dama.

"My friend and his girlfriend had sex on the bed while we had sex on the floor.

"The next morning, I woke up to find my girlfriend having sex with my friend. I got very angry," said the accused.

"I started slapping her and I assaulted her with a large gas lighter."

The accused denied that he raped the girl, saying "she enjoyed it".

He told the court that he and the girl first engaged in foreplay, adding that the complainant was aroused and continued to kiss him when they had sex.

Prosecutor Job Masina called a professional nurse who presented evidence that the girl had experienced vaginal penetration.

Vincentia Dlamini testified that she had lacerations above the left eye as well as on the left palm of her hand.

"We also have signs of a tear in the vagina as well as bumps and bruises."
