Magakwe fights ban

SPRINTER Simon Magakwe lodged an appeal against his two-year doping ban at the Court of Arbitration for Sport (CAS), but more than a month later he has yet to pay the filing fee.

Magakwe was suspended by the IAAF, the world governing body for athletics, for refusing to submit to an out-of-competition test in December.

Announcing the ban last week, the IAAF said Magakwe - the only SA sprinter to have run the 100m in under 10 seconds - had not lodged an appeal to the Switzerland-based CAS within the prescribed 45-day period.

But the athlete's lawyer, Mohale Magoshi, said an appeal was filed in time, on March 10.

Asked for comment, a CAS official told Sowetan in an e-mail: "Counsel for Mr Magakwe did file a notice with CAS but did not pay the filing fee of CHF1000 (about R13000) despite reminders.

"Consequently, since the appeal was incomplete, the CAS could not initiate an arbitration procedure in this matter."

Magoshi said yesterday Magakwe was aware of the unpaid fee: "The matter is not over. Magakwe has not instructed us to withdraw."He added he expected the CAS appeal to proceed after Magakwe had paid the fee.
