Some credit providers show no respect for the National Credit Act and their clients.
They do not give clients pre- agreement disclosure or the terms of their contract, allowing the credit provider to benefit by exploiting the client's ignorance.
The act requires a credit provider to disclose all terms and conditions of the contract before it is concluded - including explaining the penalties should the consumer decide to cancel the contract.
Susan Khumalo has accused Imperial Select-Tata East Rand of ignoring these provisions.
In November last year she paid a deposit of R10000 to a Tata dealership in Boksburg for a vehicle she wanted to buy.
She says a salesman called Presley made her sign a binding offer to purchase instead of giving her a pre-agreement statement.
"I told the salesman I was under administration and could not get a loan, but was expecting money from my ex-husband," Khumalo says. "He accepted this."
But Khumalo's former husband did not give her the money as promised.
She wanted to cancel the contract and get her R10000 back, but Presley and his manager, Rassie Venter, refused to give her a refund.
