Court to hear application to compel Zuma to suspend NPA head

A full bench of the Pretoria High Court will on Thursday hear the joint application of the Helen Suzman Foundation and Freedom Under Law to compel President Jacob Zuma to suspend National Prosecuting Authority (NPA) head Shaun Abrahams and two other senior NPA officials pending an enquiry into their fitness to hold office.

The other two NPA officials are Dr Torie Pretorius‚ the current Head of the Priority Crimes Litigation Unit‚ and Sibongile Mzinyathi‚ the current Director of Public Prosecutions for North Gauteng.

The Helen Suzman Foundation and Freedom Under Law argue that the suspensions of the three NPA officials are necessary as a result of the circumstances “surrounding the preferring and withdrawal of insupportable and trumped up criminal charges against [Finance] Minister Pravin Gordhan‚ MP and others‚ with disastrous consequences for the administration of justice and the economy”.

“In his answering papers‚ the President has indicated that he is of the view that utter incompetence‚ recklessness and misconduct on the part of the relevant prosecutors are not grounds warranting a suspension or institution of a disciplinary enquiry‚” they state.
