Juju has not given up hope and will fight on

EXPELLED ANC Youth League leader Julius Malema has 14 days to appeal his sentence before the ANC national appeals committee.

Late last night, the ANC national disciplinary committee (NDC) announced that Malema had been expelled from the party.

League secretary Sandiso Magaqa and spokesman Floyd Shivambu were suspended for three years.

In a statement, NDC chairman Derek Hanekom said Malema did not show any remorse during mitigation of sentence.

"Save for an apology from comrade Shivambu with respect to one of the charges, all three respondents did not show any remorse or acceptance of wrongdoing.

"Comrade Malema is a repeat offender. He has now been found guilty of two serious offences in under two years whilst under suspension after his 2010 finding; has shown no remorse; is not prepared to be disciplined by the ANC and is not prepared to respect the disciplinary machinery of the organisation," he said.

Magaqa's suspension would kick in if he is found guilty of misconduct in terms of the ANC constitution during the period of his suspension.

Subject to his right of appeal, Magaqa is expected to make a public apology to ANC NEC member and Minister of Public Enterprise Malusi Gigaba within 15 days. If he does not apologise, he will be suspended immediately.

"Comrade Magaqa should have realised that pronouncements by him as secretary general of an organ of the ANC would carry a lot of weight and would readily be accepted by youth league members as authoritative.

"Comrade Magaqa's unwarranted personal attack against comrade Gigaba was prejudicial to the integrity and repute of the ANC and constituted a serious offence," Hanekom said.

On Shivambu, the NDC said: "This sanction is applicable to Shivambu's membership of the ANC Youth League. Consequently, he shall vacate his position as a member of the national executive committee of the ANC Youth League".

He could also appeal the sanction within 14 days.

ANC spokesman Keith Khoza said Malema could appeal the 2010 and the latest sentence concurrently.

"If he appeals, he will stay in office, but if he does not he will have to vacate it."

Malema was in Limpopo when he received the news about the verdict.

Malema last night said he has accepted the ANC's decision to expel him but had not given up hope.

"I am a soldier who is prepared to die in a battle. Even if I am expelled from the ANC my blood will remain black, gold and green. I am prepared to do blood tests to prove that," he said addressing more than 500 people who had gathered outside his grandmother Sarah's house.

Malema said that he had expected the decision.

He said he went to Limpopo because people have been camping outside his grandmother's home and pestering her with questions about what Malema would do next.

Near the house a clearly anti-Malema group was celebrating with firecrackers and carrying a makeshift tombstone with words "'RIP Julius Malema".

They said they were celebrating the "fall of a dictator".
