Tow-truckers need to adhere to municipal bylaws and Consumer Act

THE South African Towing and Recovery Association's chairman Andre van der Merwe said: "There is a bylaw in the Westonaria municipality. It compels all tow truckers operating in the area to be part of the West Rand Towing and Recovery Association. The municipality's department of safety and security should enforce their bylaws."

Ettienne Pel, of the United Towing Association of South Africa, said Ricci had recently applied for membership under their umbrella body. He was not sure if his application had been successful.

He said the Consumer Protection Act stipulated that a price should be agreed on in writing before any towing happens.

He said if this was not done then the contract was illegal and the Consumer Commission could be approached. The parties should go to court and get an order to remove the vehicle at no cost.
