Zuma 'drink spiller' case postponed

THE man found guilty of spilling his drink on President Jacob Zuma will be back in court in November

"The case has been postponed to November 1 for the mitigation of sentence and sentencing," Durban Magistrate Gugu Mphikeleli said.

Daryl Peense was found guilty of assault on July 27, said National Prosecuting Authority regional spokesperson Natasha Ramkisson.

The mitigation of sentence and the sentencing was expected to be done yesterday but it was delayed because Peense's legal team has requested reports from probation and correctional officers.

The defence also needed to view Mphikeleli's judgment which had not been transcribed, the court heard.

Peense was arrested during the Durban July horse race last year.

During the trial, Peense denied deliberately spilling his drink on the president, claiming it spilt when people pushed against him to get a better view of Zuma.

He claimed he was drunk at the time and was standing over a balcony when this happened.

It emerged during the trial that the spilled drink did not touch the president as a bodyguard had shielded him.

Presidential protection unit officer, Constable Funani Nemaenzhe, and Captain Bongumusa Maphumulo gave evidence at the beginning of the trial.
