Minister to appeal 'lenient' sentence for driver

Motorist drove her car into a concrete block and ploughed into a group of school pupils

TRANSPORT Minister S'bu Ndebele will appeal against a suspended five-year sentence imposed on a motorist found guilty of culpable homicide and reckless and negligent driving.

Nicolette Goss, 35, was sentenced by a KwaZulu-Natal magistrate on Wednesday.

Goss, a Sydenham, Joburg, resident and a former Pinetown police reservist, was also sentenced to three years' house arrest.

She also has to perform 16 hours of community service for each month of the three years and her driving licence was suspended for six months.

In 2006 Goss drove her car into a concrete block and ploughed into a group of Charles Hugo Primary School pupils. The incident happened in Randles Road, Sydenham.

Thabani Mngadi, 12, was killed and Mhlengi Ngobese and twins, Phumelela and Nomnotho Kweyama (aged 11 at the time), were injured.

"The sentence is not commensurate with Goss' conduct and must be reviewed," Ndebele said.

"For offences such as speeding the courts have imposed heftier sentences, including fines of more than R100000."

On Wednesday South Africa joined the rest of the world in launching the United Nations Decade of Action for Road Safety 2011-2020.

South Africa will see a similar case resuming in the Protea magistrate's court next Friday. In it musician Molemo "Jub Jub" Maarohanye and his friend Themba Tshabalala are accused of plunging into a group of high school pupils, killing four. Two others were seriously injured.
