Back at work after 12 years

AFTER being on suspension for nine years, followed by dismissal three years ago, a senior state prosecutor will resume work at a Queenstown court on Monday, the Public Servants Association (PSA) said yesterday.

Primrose Songwevu, who was based at the Randburg magistrate's court at the time, was suspended in 1998 after allegations of fraud, Gauteng PSA manager Monica Venter said in a statement.

She was later dismissed in 2007.

Venter said: "The (National) Prosecuting Authority never charged her with misconduct, and only provided her with a dismissal letter in July 2007. She was clearly unfairly dismissed.

"The PSA took the matter on arbitration and the arbitrator ruled that she should be reinstated.

"The NPA, however, decided to take the matter on review to the labour court. The court overruled the NPA's application and ordered that Songwevu be reinstated."

The labour court in Johannesburg ruled on July 9 that Songwevu be reinstated to her position.

"This ruling is a victory against the unprincipled conduct by the NPA of breaking the laws of which they are custodians.

"The Labour Relations Act requires that any termination of employment must be fair," Venter said.

She said Songwevu was given choices on where she wanted to work and she chose Eastern Cape.
