'Deadbeat fathers' shamed on Facebook - Law expert says there is a case for defamation

Frustrated mothers have now taken their fight against child maintance defaulters to Facebook.

The Izinja ezingondliyo (Dogs that don't pay maintenance) Facebook page was created on October 25 and by 6pm yesterday it had 78683 followers.

A Cape Town pastor also found himself in the spotlight after his picture was shared.

The Khayelitsha pastor's post had the most comments on the page so far.

The post read in part: " Heee nina bakhonzi, yimani ndiphunge kuqala. Beniyazi uba noo Pastor abondli inoba imali yomnikelo neyezi shumi ithwani. (Hey congregation, wait let me have a drink first. Did you know that even pastors don't pay maintenance, I wonder what happens to tithes and church offerings)."

The post had about 2000 comments from users who accused the pastor of being ignorant while others pleaded with him to support his child.

It was shared 219 times.

"... oko wamka kowabo ngo 2006 umntana une 11 zange wambona. (He left home in 2006 and has never seen his 11-year-old child)," the post continued.

In retaliation, men also created their own page yesterday and called it Reasons why singondli (we don't pay maintenance), which had about 19878 followers by 6pm yesterday.

Users exposed their children's mothers for "misusing" maintenance money.

One post reads: "[name] andikazumondla umntwana akafani tu nam plus nomama uyaybona loonto so forget. Funa omnye umntu ozokondla not mna. ([name] I will not maintain that child as there is no resemblance to me, even my mom can see that. (Find someone else who will pay maintenance and that is not me)."

Another post read: "Wandishiya nesigulo usisi onegama endonqena ulibiza, Mali yokondla yile ndiya ngayo kwa ggirha ke. (One lady I won't mention by name left me with a sickness and I am using the maintenance money for the doctor's consultations)."

Another one wrote: "[name] Yeka Ukumane Uthi Ndingu Tata Womtana Kodwa Wawu Tjapazisa Apha Usihla Wenyuku Nentlobo Zama Doda Nama Gweja Ayakwazi. ([name] Stop saying I am the father of your child, you know you were busy with different kinds of men, including foreigners)."

Social media law expert Emma Sadleir said there was a clear case for defamation of character.

"Two things will be looked at when dealing with this case, firstly, if it is in the public interest or [secondly, if], it is just naming and shaming on the part of the parent, which is a defamation of character," Sadleir said.

 

Zandile Zele commented on the Izinja ezingondliyo page in relation to the pastor: "How can a child fast for 11 years?"

Another user, Kuhle Yethu Mabhedla Ngquze, wrote: "Courts have failed a lot of women and the only language people understand is social media."

Mamntakwende Maleta Mboyi wrote: "This page is good for venting out and disclosing ezizinja zinemisila ngaphambili (these dogs with tails in front)."

The pastor's wife responded by saying she was the one who stopped her husband from paying maintenance because the baby's mom was not sending them pictures of the child.

To share their stories, mothers are asked to inbox information and photos of the "defaulters" which are then shared on the page.

The administrator could not be reached for comment.

Nobahle Magcwanini KamaMemela wrote: "Like seriously guys, is this necessary? Letting everyone know ukuthi ayindliwa ingane yakho nokuthi why ungondli, akuyondli ingane (that your baby is not supported and reasons behind your decision).

"This is just selfish and childish too. Man up and do the right thing ..."
