Nomgcobo Jiba intends to appeal - lawyer

The National Prosecuting Authority’s spokesman Luvuyo Mfaku said the NPA was not commenting “at this stage” following a high court judgment which struck the names of senior NPA officials Nomgcobo Jiba and Lawrence Mrwebi off the roll of advocates.

However‚ attorney for Jiba‚ Zola Majavu‚ has indicated he had been instructed by Jiba to apply for leave to appeal against the judgment of Judge Francis Legodi passed on Thursday morning.

The striking of Jiba and Mrwebi off the roll means they are likely be disqualified from their posts at the NPA‚ because they are required to possess legal qualifications that would entitle them to practise in all courts in the Republic and be fit and proper for their posts.

The General Council of the Bar applied for Jiba‚ who is deputy prosecutions head‚ and Mrwebi‚ Specialised Commercial Crime Unit head‚ from the roll of advocates.

The General Bar Council made the application following scathing criticisms of their conduct in the number of judgments.

Majavu said Jiba was criticised in four judgments in various courts‚ the criticisms in three of the cases did not warrant that her name be struck off the roll.

“At this stage‚ the court has found she is not fit to be on the roll. It is against this finding that I have been instructed to apply for leave to appeal.”

Although the judgment by Legodi made damning findings against Jiba‚ Majavu said his client had a different take to these findings.

“The court has found that way‚ but she is entitled to challenge those findings‚” Majavu said.
