Long-serving employees retrenched by Woolworths and replaced by non-fulltime staff have been reinstated with pay backdated to their date of dismissal.

The Labour Court handed down a “landmark” judgment in the matter between the South African Commercial‚ Catering and allied Workers Union on behalf of members and Woolworths‚ Saccawu said in a statement this weekend.

Woolworths has apparently signalled its intention to appeal against the judgment.

“This judgment is significant in the current context of the job loss bloodbath in the wholesale and retail sector where most employers do not engage in a meaningful joint consensus-seeking process envisaged in Section 189(2) of the Labour Relations Act‚” Saccawu noted.
