How to get excluded

  • Get a tender from a governmental department.
     
  • Fail to deliver as per contractual agreement.
     
  • Give the concerned department the runaround.
     
  • The department sends your name and that of the company's to the provincial treasury for blacklisting.
     
  • You are given time to say why this should not be done.

  • If you don't offer valid reasons, you and your company are blacklisted in terms of Treasury Regulations 16A 9.1 (c).

  • A blacklisted contractor has the right to contest restriction in a court of law.

  • Entities can be restricted for a period not exceeding 10 years.
  • You are no longer allowed to tender.
