Alleged to have robbed a supermarket
A DEFENCE advocate has pleaded with the Lehurutse Magistrate's Court to refuse an extradition application of two men by the Botswana authorities.
Appearing before magistrate Butinyana Mlangeni are Ngqabuthu Mbele, 32, a Zimbabwean national, and Stanley Ndlovu, 34, a South African.
The Botswana government claims the two, five months ago, allegedly robbed a supermarket at BBS Mall of airtime and R138,000 in cash.
The high commissioner of Botswana requested the SA Department of International Relations and Cooperation to extradite the suspects.
Opposing the application, Mafikeng Justice Centre senior litigator Advocate Nzame Skibi told magistrate Mlangeni that if the suspects were extradited to Botswana they would not receive a fair trial as that country's constitution did notguarantee them the right to have legal representation at the expense of the state.
He said in Botswana the men would face 20 years' imprisonment with corporal punishment.
He also said the Botswana government did not give medical treatment to awaiting trialists who were foreigners.
Mbele is living with HIV, while Ndlovu has TB.
The case continues today.
