A PRISON warder who was raped by a former prisoner and his friend at her house in the Baviaanspoort Prison complex in Pretoria is suing her employer for damages.
The warder was in tears, but managed to smile after former prisoner Johannes Modise Monama, 23, and Marebele Edward Sebetsho, 28, were convicted of raping her by the Pretoria high court yesterday.
Judge Bert Bam found them guilty of housebreaking, rape and robbery with aggravating circumstances.
Judgment was handed down in the absence of Monama, who refused to come out of the court cells.
Their frail, blonde victim said she would proceed with a damages claim against the Department of Correctional Services.
She has been on special sick leave since the incident at her house in August 2008, and said she doubted she would return to work as she felt she was being victimised and had received no help from her employer.
"I don't know what the future holds. I doubt if I will go back, but I'm definitely continuing with my claim."
She and her daughter are still receiving psychiatric and psychological treatment. They have since moved in with her mother in Middelburg, Mpumalanga, where she says her daughter is doing much better.
She told reporters she was glad that justice had finally been done and that she hoped to be present when Monama and Sebetsho were sentenced.
Bam accepted the warder's evidence that both of them raped her.
She testified that Monama had threatened to kill her and her 4-year-old daughter and had violently raped her in front of her hysterical child.
After raping her, he called Sebetsho, who also raped her before the two of them made off with her jewellery and cash.
Her husband found her in shock and still tied up when he arrived to pick up their daughter shortly after the incident. Both men were wearing her jewellery when they were caught near the prison later that day.
Bam rejected Monama's claim that he and the warder had a sexual relationship, that she invited him and Sebetsho into her home early that morning and that they had consensual sex.
The trial was postponed to July 27 for the defence to obtain pre-sentencing reports.
