A teacher who police allege was caught red-handed having sex with a 13-year old pupil has a daughter older than his alleged victim

This emerged in the teacher's bail application in the Port Elizabeth Magistrate's Court, the Dispatch reports.

The 38-year-old teacher, who cannot be named because of the nature of the crime involving a minor, has previous convictions for assault and driving under the influence of alcohol.

He was granted R1000 bail and the case was postponed to December 10 for further investigation.

In his submission to the court, the teacher said through his lawyer, Patrick Septoe, that he would enter a not guilty plea when his case went to trial.

The father of a 14-year-old child is accused of having sex with the 13-year-old girl who had previously been in his class.

He is married and has been in the teaching profession for the past 17 years, his lawyer told the court.

He was arrested last Friday in the veld near Malabar after members of the police spotted his bakkie, which they suspected at first as being a stolen vehicle.

The officers realised they could not see clearly into the front because it had tinted windows, but when they went to check at the back they saw the man with the 13-year-old girl.

The court also heard that the Department of Education was in the process of suspending him.

"I am going to accept my suspension pending the finalisation of the case," Septoe said on behalf of the teacher.

The school's principal said school was operating as normal and the teacher in question was not there.

"Parents have no reason to fear. We plan to get a substitute teacher."
