Ousted Limpopo chairperson Lehlogonolo Masoga has lodged an application in the Johannesburg high court to stop the league from going ahead with a disciplinary action against him.
In his court application, Masoga argues that the ANCYL national executive committee (NEC) has already prejudged the case against him and the proceedings were accordingly designed specifically to ensure his eventual expulsion from the ANCYL.
Masoga's application is based on information he allegedly received from ANCYL deputy president Andile Lungisa that the NEC took a decision that the hearing should find him guilty and expel him.
"I am not able to wait until the outcome of the hearing nor am I able to wait until an appeal process is finalised.
"The fact is that an appeal against the decision ultimately lies with the NEC of the ANCYL, which, I allege, has already decided on my expulsion," he said in his application on Sunday.
Masoga had indicated that Lungisa would file an affidavit to support his court application to stop the league from going ahead with disciplinary action against him.
Masoga is accused of having brought the ANCYL into disrepute. In April Masoga and his supporters walked out of a ANCYL conference in Limpopo.
They accused ANCYL president Julius Malema and his supporters of hijacking the event.
Masoga and his supporters refused to recognise the leadership elected at that conference.
A source in the ANCYL NEC told Sowetan that it was a matter of time before charges were brought against Lungisa.
"He will be charged for breaking ranks with the NEC and bringing the ANCYL into disrepute," said the source.
Lungisa is also contesting against Malema for the ANCYL presidency in 2011. The move has raised both Malema and his supporters' bile.
Yesterday ANCYL Gauteng treasurer Andile Masuku accused both Masoga and Lungisa of divisive behaviour.
ANCYL spokesperson Floyd Shivambu said he could not predetermine what the league would do should Lungisa file an affidavit in support of Masoga.
