A MAN who was allegedly beaten up by the police and wrongfully arrested for the murder of his mother says the cops are refusing to lay assault charges against their colleagues.
Phineas Chauke's mother, Tsatsawani Mabasa, was found dead near Phungwani village on September 17 2006 after she had gone to drink traditional beer in the vicinity.
The 69-year-old pensioner's body was found under a tree with visible wheelbarrow tracks and footprints.
A week later Chauke , his wife Mihloti and daughter Nyeleti were arrested.
Both mother and daughter were released the next day after they were allegedly assaulted.
Chauke was allegedly assaulted and spent three months behind bars after he was charged with his mother's rape and murder .
The community, which had vouched for Chauke's innocence, paid his R3000 bail.
A state witness, Raymond Chauke, was to later tell the court that he knew the people who killed the granny.
Chauke said the killers had given him money to implicate the accused.
Since the end of the case, Chauke has tried to open a case of murder against the people who allegedly killed his mother.
"But the police tell me that it is the witness who is supposed to open the case," Chauke said.
"When I was unfairly arrested, it was because the police were friends with the son of one of the culprits.
"They arrested and charged me because I was an unimportant person who was nagging them."
Chauke says his wife has also tried to lay assault charges against the police but "she has always been turned away at the Malamulele police station."
Malamulele police spokesperson Inspector Alson Mapindani confirmed to Sowetan that the court cleared Chauke of the murder and rape of his mother.
