FOLLOWING explosive corruption allegations against the prosecutor in the Jackie Selebi corruption trial yesterday, the former police chief's defence lawyers might ask Gerrie Nel to recuse himself.

Defence witness Prince Mokotedi, a senior NPA official tasked with investigating corruption in the Scorpions, told the court he had investigated Nel for allegedly siphoning off money from a secret NPA account.

Wits Law Clinic's Professor Stephen Tuson said once a legal representative becomes directly involved in an issue in the case, he becomes compromised in that he now has to cross-examine a witness in a matter that involves himself.

"What could happen is that the prosecutor may well be called to testify in a case which he is supposed to be in charge of.

"Normally in that event he would step down and another member would cross-examine the witness of his behalf ."
