THE Constitutional Court has dismissed the State Security Ministry's bid to prevent ex-intelligence co-ordinator Barry Gilder from testifying in the trial of former police boss Jackie Selebi, pictured.

"The Constitutional Court has considered the application for leave to appeal. It has concluded the application for leave to appeal should be dismissed as it bears no prospects of success," the court order read.

Gilder will now be allowed to testify in the Selebi trial, set to resume on March 1.

"We will now proceed to subpoena Mr Gilder for the 1st of March so that we can proceed," said NPA spokesperson Mthunzi Mhaga.

The Johannesburg high court and the Supreme Court of Appeal had ruled that Gilder testify in camera in the corruption trial of the former national police commissioner. - Sapa
