Commissioner Thulani Ntobela was testifying yesterday in the sentencing of former Goodwood police station commander Siphiwe Hewana for defeating the ends of justice.
Hewana was found guilty in November of attempting to defeat the end of justice, but was acquitted on two other counts - conspiracy to commit perjury and interfering with police officials in the execution of their duties.
Yengeni was arrested on a charge of drunken driving in November 2007, but was found not guilty in December 2008.
Testifying in Hewana's trial, Ntobela said Hewana's interference had caused the two constables involved in Yengeni's arrest anxiety.
Hewana instructed the two constables to fraudulently open a second docket and to destroy the first to protect Yengeni.
Ntobela said the constables were uncertain of their future in the police service after Hewana's interference had come to light. They also feared they would face criminal charges, he said.
Ntobela said the investigating officer in the Yengeni drunk driving case, Captain Mthozani Madikane, had "refused point blank" to testify in the Hewana case. - Sapa
