His lawyer and the prosecutor yesterday argued over whether photographs of Mbatha, which appeared in Sowetan immediately after his arrest, did not help witnesses identify him.
Jack Gerber (for Mbatha) told the court that one of the witnesses, Lenah Kumape, wrote in her statement that she was shown a copy of Sowetan and asked to verify whether the man in the picture was indeed the one who robbed her employer's house in Bedfordview
Mbatha, who is facing an assortment of charges, was applying for bail for the second time since his arrest on August 12. He will appear in court again on Wednesday.
