RESIDENTS of the Harry Gwala informal settlement on the East Rand will take the Ekurhuleni municipality to the Constitutional Court today on a dispute over basic services.

RESIDENTS of the Harry Gwala informal settlement on the East Rand will take the Ekurhuleni municipality to the Constitutional Court today on a dispute over basic services.

The residents seek leave to appeal a South Gauteng high court judgment.

They approached the high court for an order for communal water taps, temporary sanitation facilities, refuse removal and high-mast lighting in key areas.

This was pending a decision by Gauteng local government and housing MEC to upgrade the settlement to a formal township after a proposal was submitted in August 2006.

The applicants argued that the municipality was obliged in terms of the Housing Code and the Constitution to provide the basic services demanded.

The high court found emergency housing requirements defined in the code were not present. - Sapa
