Appeal bid will delay inquiry

An APPEAL by Judge Nkola Motata against his drunk driving conviction will stall the decision by the Judicial Service Commission on whether to launch an inquiry on his fitness to hold office.

An APPEAL by Judge Nkola Motata against his drunk driving conviction will stall the decision by the Judicial Service Commission on whether to launch an inquiry on his fitness to hold office.

Motata indicated that he would appeal against both his conviction and sentence.

The date of the appeal will be decided next week.

Attorney Tumi Mokoena of Tumi Mokoena Incorporated said though it would be reasonable for the JSC to proceed since Motata had been convicted, a pending appeal warranted them to wait.

"He can't be treated as innocent by the JSC, but he also has a constitutional right to appeal."
