McBride told the Commission for Conciliation, Mediation and Arbitration yesterday that he had an oral agreement with the then mayor Duma Nkosi, city manager Patrick Flusk and director of Community Safety Mkhabela Sibeko that his contract would be extended for a further three years.
McBride was fired by the current executive mayor Ntombi Mekgwe in September last year.
He said on certain occasions he met with Nkosi and Sibeko at their homes where the agreement was re-affirmed.
But council's legal representative, Advocate Kennedy Tsatsawane, retorted: "If the oral agreement was written we would not have been sitting here."
The exchange between McBride and Tsatsawane became tense at some stage during the hearing when McBride denied receiving a letter from an official which did not include that there was an oral agreement.
Meanwhile, Sapa reports that Hlula Msimang was appointed to replace McBride as the metro police chief for Ekurhuleni.
