This after the supreme court of appeal ruled in March that Ermelo Hoërskool remain an Afrikaans medium school.
The court ruled that the department's decision to suspend the powers of the school governing body to determine the language policy be set aside.
Yesterday the department's lawyer Bantubonke Tokota said it was not disputed that it was a single medium school and the language policy was Afrikaans.
"But the SGB failed to revisit the language policy. It is unreasonable. The school has been around for 90 years but failed to change the imbalances of the past."
Wim Trengove, representing the school, said: "To suggest that the school is indifferent to the plight of others in the area is incorrect."
The case was postponed for judgment.
