There is a faulty impression doing the rounds suggesting that the courts have made a ruling that Clive Derby-Lewis, the killer of SA Communist Party leader Chris Hani, should stay in jail.

However, what the court said was that it was not up to it to make the decision and returned the matter to the parole board.

This means that in theory, there is still an equal chance that Derby-Lewis could be freed just as there is that he could end up dying in jail.

The department ought to have prepared the nation for a decision that has the potential of dividing the country along racial lines. Hopefully they will do a better job of communicating once a decision is made on this matter.
