This means that in theory, there is still an equal chance that Derby-Lewis could be freed just as there is that he could end up dying in jail.

The department ought to have prepared the nation for a decision that has the potential of dividing the country along racial lines. Hopefully they will do a better job of communicating once a decision is made on this matter.
