The South African Human Rights Commission is planning to take the Mpumalanga education department to court over its failure to make sure that all matriculants received their results on time.
There are about 600 matriculants who have still not yet received their results.
Political parties, including the Christian Party (CP), have lodged formal complaints with the SAHRC about the matter.
SAHRC spokesman Vincent Moaga confirmed that the commission was planning to take the Mpumalanga education department to court over the outstanding results.
"The delay is tampering with the matriculants' rights to higher education," he said.
Moaga said the commission had been engaged with Education Minister Naledi Pandor about the matter and that promises had been made that a solution would be found soon.
CP national leader Louis Marneweck confirmed that his party had laid a formal complaint with the SAHRC, saying what was more disturbing was that the department kept on making "unnecessary" delays.
Provincial education spokesman Jasper Zwane said the department had "made some significant progress on this issue and would issue a statement soon".
Regarding the lawsuit, Zwane believed the SAHRC would consult the department before taking it to court.
