The ANC says it will take legal action against its disgruntled members, led by its former chairman Mosiuoa Lekota, if the group uses any name or symbols associated with the ruling party's.
The threat to take legal steps comes after an announcement by Lekota's supporters in Western Cape that they wanted the soon-to-be-launched breakaway party to be called the SA National Congress.
ANC spokesman Brian Sokutu said the ruling party would "definitely object" to the name.
"We will seek legal advice if they use anything associated with the ANC," Sokutu said.
Both Lekota and former Gauteng premier Mbhazima Shilowa are leading an initiative to form a breakaway party after accusing the new ANC leadership of having veered away from the Freedom Charter.
The new initiative has been dubbed Shikota - a combination of the two leaders' surnames.
Shilowa is organising a national convention where like-minded groupings are to discuss the political direction the new party will take.
The convention is to be held in Bloemfontein at the weekend.
Meanwhile, the Shikota group has moved quickly to set up new structures in Cape Town, claiming 12 branches in Khayelitsha alone.
