Witness will testify despite memory loss

It has been confirmed that the metro police officer who assisted his two female colleagues to arrest Pretoria high court Judge Nkola Motata suffers from memory loss.

Motata is on trial for drunken driving and defeating the ends of justice.

A seven-page report by his doctor handed in at the Johannesburg magistrate's court yesterday says Moatlhodi Daniel Madibo "has his short-term memory afflicted in certain aspects".

But the report says that Madibo, 46, can remember the events he participated in but he might not remember what someone else said.

"He does not have total loss of memory," it said.

Madibo claimed last week that he could not remember most of the things he had said at his previous court appearances because he was involved in a car accident.

Magistrate Desmond Nair had asked Madibo to get a report to support his claim.

"After reading the contents of the medical report and discussions with both counsels, it is this court's decision that the witness (Madibo) is competent to testify and that the report be provisionally accepted," said Nair.

The trial continues.
